Southern Methodist University (SMU) Mustangs Football National Championship Wins - 3 Victories

The Southern Methodist University (SMU) Mustangs football program claims three national titles in the nearly one hundred years that the sport has been played at the college in the Dallas, Texas area. The three national championships are from:

  • 1935

  • 1981

  • 1982

While SMU has never been awarded the distinction of a football national championship from the most highly regarded polls generated by the Associated Press (AP) or the Coaches Poll or even the more recently created Bowl Championship Series (BCS) system the university does claim football national championships based on designations bestowed on them by alternative sources.

When it comes to the highest level of college football the National Collegiate Athletic Association (NCAA), which has tournaments and formally recognizes a national champion for every other college sport, has refrained from officially crowning a college football national champ at the highest level. Prior to 2006 the highest level of college football was called Division 1-A. Since 2006 the term Division 1-A has been replaced with Division I Football Bowl Subdivision (FBS). With regards to both Division 1-A and more recently Division I FBS the NCAA only states that "a number of polling organizations provide a final ranking."

Despite the fact that the NCAA organizes a tournament and pronouncing an eventual national champion at the Division-II and Division-III levels of college football the governing body of college football has chosen to abstain from officially declaring a FBS (formerly Division-IA) national champion. Because of this fact a number of colleges have chosen to claim national titles for historical seasons despite consensus opinions to the contrary.

In 1935 the SMU football program went 12-1 in a season that was concluded with a bowl victory after beating Stanford 7-0 in the Rose Bowl in Pasadena, California. Three different organizations declared the SMU team led by head coach Madison Bell as the best in the country. Those three organizations were (1) Dickinson, (2) Houlgate System, and (3) Sagarin Ratings.

In 1981 the Dallas based institution of higher learning claimed a second national championship after a 10-1 season under coach Ron Meyer where the Mustangs did not conclude their season with a bowl game. The low profile organization that declared SMU the best college football team in the country after that season was the little known group called the National Championship Foundation.

In 1982 Bobby Collins coached the SMU Mustangs to an 11-0-1 record over the course of a season that concluded with a thrilling 7-3 Cotton Bowl victor over the University of Pittsburgh. Future NFL Hall of Fame running back Eric Dickerson led the squad that finished second in the AP and Coaches Polls.

Although Penn State was widely accepted as the national champion with a substantially more difficult schedule than SMU the Penn State program finished with an 11-1 record. The lone loss to then number four ranked University of Alabama gave an organization that calls itself the Helms Athletic Foundation sufficient reason to declare SMU the national champion because the Mustangs finished with one tie and no losses while Penn State had one loss in week five of the 1982 season.

The Independent Insurance Agents and Brokers of America or IIABA revealed in one of their reports that the average cost of Renters Insurance is about $240 a year, $12 a month or $3 per week. The average cost is for an insured policy with a content replacement or property coverage of $30,000 and liability coverage that amounts to $100,000. The computation of your premium rate actually depends on a lot of factors: age of your house (the older your house is the higher your premium cost); the area or location where you live (the high-risk area and the higher cost of living means higher premium rate); how much you are willing to pay for your deductible (the higher the deductible the lower the premium rate), and lastly is your insurance company.

Do you belong to the 2/3 of those who are renting an apartment or house and yet do not carry a renters insurance? Statistics were drawn out from IIABA's consumer survey and was conducted by a third party through a national consumer telephone survey. Out of the 1,000 people whom they've asked, 64.4 percent answered "no" to having a renters insurance policy even when the average cost of renters insurance is not that really expensive because this is the top reason and misconception of these individuals. There were at least 2.2 percent who answered "don't know" which means that they are not aware that there exist an insurance policy designed for those who are renting.

To erase the misconception of an expensive premium cost for insurance policy of rental properties, here is the data about the average cost per state. The figures are based on the 2006 data of the National Association of Insurance Commissioners. The US countrywide cost is $189. I Recently an article in the Iowa Quad City Times has many wondering just what the rules are requiring an heir to repay Medicaid for the cost of services to a deceased family member.

Sarah Miller received a letter from the State of Iowa asking for $277,186.96 to repay the State for medical care received at a state-run veterans home. Ms Miller is the long time companion of veteran Roger Lennon who died a few months ago.

Roger Munns, a spokesman for the Iowa Department of Human Services confirmed that the State would seek reimbursement from any assets remaining in Lennon's estate after he died. Munns said that Mr. Lennon should have known that the state would pursue any remaining assets remaining after his death.

Munns states that "everybody who gets Medicaid is told that this is a government program for which we will be expecting repayment."

Mr. Lennon gave all of his income to the State during the times he was living at the Veterans Home in Marshalltown. This income consisted of his veteran's benefits and $350 which was his share of the rental income from properties jointly owned by Ms. Miller and himself.

Ms. Miller paid the taxes and expenses of the rental properties for the last seven years. However, she was told that she could not deduct either the expenses or taxes form the estate. The only deduction the State will allow is funeral expenses. Apparently the State of Iowa has told Ms. Miller it wants half the value of these two rental properties and the payment is due next week.

How did this happen and can it happen to others? Absolutely.

Medicaid came into being in 1965. As it is a joint program between the federal government and the states, it has always included a provision allowing the states to recover from the estates of deceased Medicaid recipients.

In 1993 Congress passed the Omnibus Budget Reconciliation Act (OBRA '93) which required the states to implement a Medicaid Estate Recovery Program. The relevant provisions of the 1993 Act are as follows:

* States must pursue recovering costs for medical assistance consisting of:
* Nursing home or other long-term institutional services;
* Home- and community-based services;
* Hospital and prescription drug services provided while the recipient was receiving nursing facility or home- and community-based services; and
* At State option, any other items covered by the Medicaid State Plan.

At a minimum, states must recover from assets that pass through probate (which is governed by state law). At a maximum, states may recover any assets of the deceased recipient.

Who's estate may be seized?

According to the U.S. Department of Health and Human Services recoveries may be made from the estates of deceased persons who were 55 or older when they received benefits. Recovery could also be had if the Medicaid beneficiary was permanently institutionalized regardless of age.

States are permitted to exempt recovery if the only Medicaid benefit received is a payment of Medicare cost sharing, i.e. Medicare Part B premiums.

Of course this is made a bit more confusing because each of the states have different rules. Texas, for instance, passed a law which states Medicaid Estate Recovery Program claims will only be filed when it is cost-effective. Claims that are considered not cost-effective are those where:

* the value of the estate is $10,000 or less;
* the recoverable amount of Medicaid costs is $3,000 or less; or
* the cost of selling the property would be equal to or greater than the property's value.

Ohio has a hardship exemption. In certain circumstances when recovery from the estate is found to create an undue hardship, the right to immediate recovery may be waived by the state. The Ohio statute gives as an example a property which is the sole income producing asset of the survivor. Ms. Miller might be eligible for a hardship exemption if she lived in Ohio.

Each state has it's own rules. Federal guidelines allow the states great latitude in defining hardship exemptions. However, the federal guidelines do suggest that two kinds of property could be eligible for hardship exemptions. The suggested guidelines are homesteads of modest value and income-producing property, such as farms or family businesses that are essential to the support of a survivor.

Even though the federal guidelines seem to favor Ms. Miller, the ultimate authority to recover is with the State of Iowa.

Ness Notes (August 7) Tuesday, November 9, 2010

Were you ready for some football? I'm not sure I was. The Eagles' Donovan McNabb completed all three of his passes (29 yards) while leading Philadelphia on a 61-yard scoring drive on the team's first possession (and McNabb's only one) of the game. After that, the only score by the Eagles came on a Hall of Fame game record 55-yard field goal by David Akers.

My free play for Monday is on the Cin Reds over the StL Cards at 7:10 ET. Coming off a 3-1 MLB weekend, I'm opening the new week with a Technical Insider (backed by two winning trends of 73%) plus a 15* ALCS Rematch on the Angels/White Sox on ESPN.

The entire backup crew contributed, as QBs Garcia and Chang each threw an interception, with Detmer losing a fumble. RB Bruce Perry lost two fumbles, giving Philly five turnovers for the game. The Raiders were slightly better, losing just two turnovers plus botching the snap on a short field goal attempt. Speaking of FGs, Janikowski kicked two long ones for the Raiders, from 50 and 51 yards. Oh yeah, the final was Oakland 16-10 over Philadelphia.

USA Today released hits preseason coaches' poll last Friday and Ohio State will open the 2006 season as the nation's No. 1 team. However, unlike last year when USC claimed all but two of the first-place votes, the top-six teams all received at least one first-place vote, the most since 2001 when nine schools garnered at least one vote . Ohio State got 28 No. 1 votes and defending champ Texas will open as the nation's No. 2 team, with 11 first place votes.

Notre Dame (nine votes) and USC (one) finished in a tie for third and Oklahoma finished fifth. The Sooners actually received the second-most first-place votes (13) of any team but of course the poll was taken prior to the suspension of the team's starting QB, Rhett Bomar. Of interest is the wide discrepancy in opinion on the Sooners this year, as they got votes from No. 1 to as low as No. 22! Auburn, which opens No. 6, was the only other school to receive a nod at the top spot.

The SEC claimed the most teams in the top-25 with six while the ACC, Big-10 and Big-12 all claimed four spots. The Pac-10 had three, the Big East two, the MWC had one (TCU) and of course No. 3 Notre Dame plays by its own rules (one could consider the Irish an independent or a member of Conference-NBC!). By the way, the last time ND was ranked this high in the preseason was 1992 (opened unranked last year).

No. 23 Tennessee, which finished last year at 5-6, is the only team to be ranked which had a losing record in 2005. No. 15 Michigan and No. 17 Iowa both finished 7-5 last year and join the Vols as the only schools in this year's preseason poll to not have been ranked in the final coaches' poll of 2005. Teams which finished last year in the final top-25 but were not among this year's first poll include UCLA (finished No. 13 last year), Wisconsin (15) and Boston College (17).

MLB notes

Go figure the Dodgers! They opened MLB's second half by losing 13 of 14 games after the break. During that run, they were outscored 81-29 with a team batting average of .222 and a team ERA of 5.41. So who's MLB's hottest team as the new week begins? The Dodgers, naturally. They've rebounded to win nine consecutive games as Monday's play begins, outscoring their opponents by 65-23 while hitting .310 and posting a team ERA of 2.55!

Elias reports that the Dodgers have now won nine consecutive games, a streak that began after they lost eight straight. They are the sixth team in major-league history to lose at least eight straight games and follow that immediately with a winning streak of at least eight games. The others: the 1931 Cubs, 1949 Red Sox, 1965 Pirates, 1985 Twins and 2001 Cubs.

The Dodgers' starting pitcher has earned a victory in each of the team's last six games and all six of those games have been on the road. In the last 10 years, only one major-league team has had a longer streak of that type. Seattle won eight straight games -- all on the road -- with a starting pitcher getting the victory each time in 2003.

The Cardinals took a seven-game losing streak into the weekend's action but after losing to the Brewers 4-3 on Friday, won both Saturday and Sunday. The team's eight-game losing streak was its second eight-game losing streak of the season and that hadn't happened since 1983! The Blue Jays ended their seven-game losing streak by beating the White Sox on Sunday, 7-3.

Of note in that game was the losing pitcher, Jose Contreras. It's Contreras' fourth loss since July 14, the day his 17-game winning streak ended, tying for the most losses for any pitcher in the majors over that period. MLB's longest active losing streak, now that St Louis and Toronto have won, currently belongs to the Royals (four games). I guess that's fitting, as KC also owns MLB's worst overall record, at 38-73.

Monday's MLB schedule features a relatively light nine-game card, including the Angels and White Sox making up a rain out from May 11 at 7:05 ET tonight in Chicago on ESPN. Of course these teams met in last year's ALCS with the White Sox winning four straight games (all complete games) after the Angels opened with a 3-2 win in Game 1.

It's hard to believe they'll be a complete game tonight, by either starting pitcher. The Angels send Kelvim Escobar to the mound and he's 1-9 with a 6.21 career ERA vs the White Sox in 18 appearances. That includes an 0-7 mark in nine starts, with a 5.64 ERA. As for Chicago's Mark Buehrle, the one-time ace of the staff is 0-5 with a 9.92 ERA in his last six outings!

Speaking of rematches, the Twins open a three-game series tonight in Detroit vs the Tigers. Detroit was able to take two of three in Minnesota from July 28-July 30 and have now won nine of the 12 meetings this year between the two teams. Tonight's pitching matchup features two rookies, the Twins' Francisco Liriano (12-2, 1.96) and the Tigers' Zack Miner (6-2, 4.03). These guys hooked up back on July 28, in a game the Tigers won 3-2 (10 innings).

Liriano allowed just three hits and two runs in that game over eight innings (12 Ks), while Miner allowed four hits and two runs in six innings. Liriano has not pitched since (left forearm?) and it will be interesting how he does. As for Miner, the Tigers are 8-3 in his 11 starts this year but his last win came back on July 16 and over his last four starts he's got an ERA of 7.36.

Auto accidents occur in Pennsylvania every day at an alarming rate. They are difficult to deal with because of their commotion, excitement and disbelief. The following are a few tips to help deal with the immediate aftermath of the automobile accident.

1. Stop Immediately! Pennsylvania law requires that if you are involved in an accident that you must stop at the accident scene. You should immediately call an ambulance if anyone is injured. However, do not try to move the injured persons. If possible, try to warn oncoming vehicles of the accident by means of a flare or bright/flashing light.

2. Call the Police - Call the Police immediately so that an accident report can be prepared. Always get the Police report number and the responding Police Officer's name and badge number. Give only your name, address, Driver's License number, license plate number, name of the registered owner of the car and your insurance information

3. Do not admit anything, even if you think that you are at fault. Being in an automobile accident causes a great deal of immediate emotion like stress, excitement and anger. Take time to cool down and think about what happened to cause the accident before you make any statements to others regarding what caused the accident or who was at fault. Instead, take down the other driver's name, address, phone number, driver's license number, license plate number, name of the registered owner of the car, state of license, and insurance information.

4. Inform your Insurance company - Make a thorough accident report to your insurance company without delay. If you are injured, go to the emergency room or have a physician examine you as soon as possible. TAKE PHOTOGRAPHS OF ALL DAMAGES AND INJURIES

5. Contact an Attorney - Contact an injury attorney as soon as possible to assist in handling problems associated with the accident. You should be cautious of any person or insurance company who offers to adjust your injury claim or tries to hurry you into a settlement. If you are involved in an accident and have a viable claim, you should not try to handle it alone. Be sure to consult with an attorney to ensure that your interests and rights are protected.

Pharmacy Technician Continuing Education Wednesday, October 13, 2010

Although currently only a minority of states actually require pharmacy technician continuing education, more and more states have been adding this requirement. Regardless of state requirements, any pharmacy technician that is certified by the Pharmacy Technician Certification Board (PTCB) needs to complete 20 hours of continuing education every two years in order to get recertified. There are many options available for pharmacy technicians to complete their continuing education requirements.

The National Pharmacy Technician Association (NPTA) has accredited continuing education programs for pharmacy technicians available in a variety of different formats including online options, in print options, in person options, and recorded options. These pharmacy technician continuing education programs have been accredited by the Accreditation Council on Pharmacy Education (ACPE).

Once you have selected one of the pharmacy technician CE options available, you either read or watch the course material, and then you return to the website to take the course test. You need to score at least 70% in order to get credit for the course. If you receive a passing score you can print your certificate showing you have completed that pharmacy tech continuing education course. If you do not receive a high enough score to pass the course the first time, you can go over the materials again and try the test once more at no additional cost.

The American Society of Health-System Pharmacists (ASHP) also has pharmacy tech CE courses available. They can be taken through online courses, reading printed matter, or podcasts. Like the pharmacy technician continuing education courses of the NPTA, once you have finished studying the material you must take a test and get a passing score in order to get the continuing education credits.

1. Nebraska's nickname honors the most valuable crop in the United States
It is true. In terms of the volume produced and its value, corn is the top crop in the USA. Thus, the Nebraska Cornhuskers are representing America's number one crop! Here are some other fascinating facts about corn:

o America produces twice as much corn as any other crop.
o Illinois, Iowa, Minnesota, and Nebraska grow 50% of US-grown corn.
o Iowa sells 55% of its corn, to foreign nations.
o Corn is a major ingredient for sodas, peanut butter, and snack foods.
o An average ear of corn includes 16 rows and 800 kernels.

2. The Nebraska Huskers were once the Nebraska Rattlesnake Boys
The Nebraska Cornhuskers have been known as such, for roughly a century. Charles "Cy" Sherman, a sportswriter from the "Nebraska State Journal," proposed that people refer to Nebraska University's athletic teams, as the Cornhuskers. Before that time, various nicknames for the team included: Antelopes, Bugeaters, Nebraskans, Old Gold Knights, Rattlesnake Boys, and Tree Planters

3. The Cornhuskers won a national championship without winning all their games
Nebraska's football team has never been defeated during their five national championship seasons (1970, 1971, 1994, 1995, 1997). However, in 1970 their record was 11-0-1, and included a 21-21 tie against the University of Southern California. Arguably, the Huskers should have won the game. In the fourth quarter, Nebraska missed a 12-yard field goal, following a bad snap from the Center. USC then scored a touchdown, to knot up the game. Ultimately, the Associated Press college football poll ranked Nebraska as the nation's #1 team.

4. The Cornhuskers have retired 22 athletes' jersey numbers
This total includes 15 men, including the football stars Mike Rozier and Tommie Frazier. Rozier had an outstanding career at Nebraska, as a running back on the football squad. During his senior year (1983), Rozier won the Heisman Trophy award-which the NCAA annually awards to the top college football player. Unfortunately, during Rozier's senior year, Nebraska lost the championship game to Miami.

Meanwhile, Tommie Frazier led Nebraska to back-to-back national championships (1994, 1995). In one ESPN.com poll (2006), voters chose the 1995 Huskers team as the top team in American college football history! Tragically, the NFL never drafted Frazier, due to a severe blood clot that his left leg contained.

Regardless of how many years we have been an NCAA team's fan, we can always learn something new about the team. You know about past NCAA titles, but you do not know about future ones. Use Nebraska Cornhuskers merchandise to cheer the team to another national championship!

In researching this article I learned there are as many opinions on the subject as there are people and no real consensus of opinion or understanding of the subject matter. However, we are in search of facts and law, not just opinions.

I spent some time in Texas last year. You can drive for days and not leave that State. Here in New Hampshire I can be in three different States in 60 - 90 minutes. Many residents live here and work just over the border. Crossing State lines is an important issue here in the Granite State.

What do you do on surveillance when the subject crosses the border? Tough call. Steve Byers, my good friend and mentor, feels this is like following a subject to a members only club, like the American Legion. Surveillance stops at the door. You have no legal right to enter. The client should be happy with the results and your professionalism. You didn't trespass.

Steve feels the same concept applies to crossing State Lines. Stop at the border, unless you are licensed there. Many licensing authorities mirror this sentiment. However, this does not make it right...or wrong.

Your driver's license is accepted in all states, temporarily, as long as you are just passing through and not living there. Your marriage license is accepted permanently. Why not your PI license?

Licensing Agents here in New England seem to subscribe to the philosophy that a license is required to cross the line to do any part of an investigation.

One New England licensing agent recently stated, to a licensed PI, that crossing the line and having a "conversation" with a witness was not an investigation, but if you "interviewed" the witness, you were "investigating." I would explain this further, but I don't quite grasp it.

There are several scenarios possible: A mobile surveillance where the person unexpectedly crosses the State line. What about a case for a NH attorney? A case in NH Court and one witness lives over the border? Or the witness lives in NH but his wife tells you he is at work, in a bordering state, close by. He does have time to see you today. Do you go?

There are a myriad of opinions and possible solutions. I network with a lot of PIs in neighboring states. I can pick up a phone and get it done. But this does not answer the question. When can you cross a State line?

DISCUSSION

Some interesting data can be found in American Law Reports, 93 ALR 2nd.

According to this compendium of cases, a licensed individual who performs a single act, or isolated transactions, in a foreign State, willnot be considered as engaging in that occupation, within the purview of the law requiring licensure of that occupation.

The Courts look at the intent to engage in these activities with any permanency: In other words, holding themselves out for hire, or "do business" in the foreign state.

A foreign (out of State) Corporation/individual, by doing a single isolated act of business, with no purpose of doing any other acts there, does not come within the provisions of a statute requiring foreign companies to comply with specified conditions before they are permitted to do business within the state.

To "do business "is to carry on any particular occupation or profession.

According to data in 93 ALR 2nd: when confronted with a single or some isolated transactions, the Court, in reality, determines the intent of the individual. This is, it seems, to differentiate the intent to complete an assignment from the intent to "do business" or hold oneself out to do business in the foreign state.

STATE BY STATE

The Dept. of Safety in New Hampshire has stated that one must be licensed in New Hampshire, period, to enter the state on any investigation.

Iowa is a bit more flexible. In order to determine jurisdiction they apply a more flexible approach:

"The Department will consider the following factors in determining jurisdiction. Types of activities that are not, by themselves, viewed as demonstrating jurisdiction in Iowa include, but are not limited to the following:

(1)A non-Iowa based private investigation business works on a criminal, civil or administrative case that that originates and is filed in another state, but contains some investigative elements in Iowa."

In North Dakota they have not had to review this type of scenario, having to cross a state line to finish an assignment. They assured me, in their letter, each case would be reviewed independently by the Board. The board feels it would be best "for an investigator to comply with our licensing requirements in anticipation of any such occurrence."

Vermont states that you must obtain a Transitory Permit (Temp. license) before entering the state. I did this once. The client needed the information ASAP and wanted me to get it. It took 30 days to get the permit. I am not complaining by the way. I have several friends in Vermont who it on the Regulatory Board. I think they have the best system in the country. I used it as a model when drafting our legislative proposal to overhaul the system in NH.

Kentucky did not answer the question. They did supply me with a copy of their licensing law but it did not address the issue directly.

Connecticut also would not answer the question, stating they cannot give legal advice and referred me to read their laws...which do not address the issue. If you need to go into Ct. don't bother to call, I guess.

INDIVIDUAL EXPERIENCES

A NH licensed investigator ended up in Vermont on a W/C case, having followed the claimant from Claremont, NH unexpectedly. He taped the claimant engaged in very strenuous activity in Vermont. The case ended up in Court, and the question of his legality was questioned by the claimant's legal counsel. The judge ruled it WAS legal because of the circumstances. The investigator was: hired in NH, by a NH attorney, to watch someone whose legal address was in NH. There was no way for the investigator to know the claimant had purchased land in VT, and was excavating to start building a house. The PI was not "doing business" in Vermont.

Closer to home is the experience of my colleague Jim Collins from Massachusetts. I have known him for many years and he is a "by the book" kind of guy yet he ran afoul of licensing authorities and he prevailed.

It was a mess dealing with the authorities in Florida mostly ex-cops at the licensing division in Florida, Jim told me.

The most informed and reasonable person he met was a female attorney general who agreed with his arguments and she killed both cases, dismissed them eventually.

In one case a subject was followed from Massachusetts to Florida. Jim later testified in Probate Court during her divorce. The wife had started an affair with a younger man from another State, and they met in Florida. Her attorney made a big deal, in Court, of Jim not having a Florida license.

Jim did not know for certain, when he started, where she was going to end up and thought (from client supplied information) she might be going to Virginia, where her suspected paramour lived.

Her attorney "reported" him to Florida Dept. of State and gave them his investigative report which made its way into the record in Massachusetts.

The Massachusetts Judge reviewed the Florida statute and agreed that Jim was not in violation of Florida law at all, as he was not "operating" a business in Florida. The Judge pointed out Florida citizens could not even find him in Florida to hire him, as he had no ads, no telephone listings, and no office.

The Massachusetts Judge said the primary reason for "business licensing" is to protect the public from unqualified persons. Jim's Massachusetts license took care of that.

Jim is regulated by Massachusetts, the Judge said, so the people up here who can find him and hire him are protected by the Massachusetts licensing authority.

The Judge in Probate & Family Court allowed all of his testimony on that case. That reduced (by at least $50,000.00) the divorce settlement proceeds the subject received. She and her boyfriend came at him with a vengeance, filing complaints and lawsuits against him 1,500 miles away in Florida. Jim prevailed. He was not operating a business in Florida.

The other case started in Mass. and ended up in New Jersey. A disability case worth millions and one day after a deposition the subject boarded a plane suddenly and Jim's investigator followed her to Florida. Should he have parachuted out or just abandoned the assignment?

They reported him when he testified at a deposition. He testified in Massachusetts and in New Jersey.

Both parties were upset and lost hundreds of thousands of dollars (if not millions) because of these investigations. That is why they vindictively filed complaints with Florida authorities. Hell hath no fury...

Incidentally, while they were "guests" in Florida, they checked in with all local Police Departments, with Massachusetts PI Id's and they could not have been treated nicer.

According to Jim, (just like the TV show):

"The biggest reason we prevailed was always our solid case that we were 'not running a detective business in Florida." Judges kept coming back to that point. We have no special police powers to do the tasks we do, the PI license is simply a business license.

The Florida Judge pointed out that when he was an attorney he often went out of state to take depositions and he was not licensed as an attorney in the foreign state. The tasks we were completing in Florida, looking up public records, monitoring someone's activities, researching, taking photographs in a public area, do not in and of themselves require a special license. Many others do those same tasks and have no special licensing. The PI license is for "conducting the business of a Private Detective in Florida" which the judges said we were not doing."

If these seems ridiculous to you consider this: Jim's firm was "doing business" in Massachusetts on a Massachusetts based case. He was visiting Florida to complete the assignment.

CONCLUSION

As I researched this article, I posted to many PI lists expecting to be inundated with replies. I got very few.

This is an issue that does not affect all of us but could affect many of us. If the circumstance arrives on our own doorstep, I think it is important that we are aware of the issue, potential problems, and the way this is viewed by the Courts and licensing authorities.

It is obvious that Courts view this differently than the majority of licensing agents. Apparently the licensing agents need to be educated and that is our task. Licensing is designed is to protect the public by keeping unqualified people out of the profession, not to prevent crossing state lines.

Crossing a State line is apparently different than "doing business" in the foreign State.

Each State has different standards to obtain the license. This could be a piece of the puzzle. A few require no license and in Rhode Island each town/city issues the license. They have debates, from time to time, about the license being valid in other cities and towns.

Perhaps in the future we will see more consistency in licensing standards and this will help to alleviate this problem.

390 days.

That's how long it's been since Barack Obama stood on the steps of the Old State Capitol building in Springfield, Illinois and announced his presidency.

It's been even longer for Hillary Clinton, who has campaigned for 412 days since announcing her intentions on running for the highest office in the country.

Mitt Romney, Rudy Giuliani, and John McCain all announced their hopes for the presidency well over a year ago. That may be the reason that two of those three have since dropped out.

The fact of the matter is this year's presidential election process has been boring. It's the equivalent of watching grass grow everyday for six hours. Not that I don't love politics and the bickering and infighting and speculation that McCain or Clinton was out of the race months ago. But for this campaign to have lasted over 480 days by the time the conventions roll around, that's absurd.

The problem is the process. We've got this long drawn out primary and caucus garbage that gets us no where but to bed earlier each night. It lasts from early January until June a total of six months. And there was a total of 10 months of campaigning before the voting even started.

The democrats also utilize the dumbest process for electing a candidate. Their formula seems like it was set up to mold a long campaign. Here's the gist of it.

Each state holds a primary or caucus, just like every other state. The difference comes with how the delegates are tallied up.

On the democratic side the DNC decided that each state will do it the same way. Some delegates are rewarded based upon the percentage of the total vote won. For example, if Hillary Clinton won 51% of the vote and Barack Obama won 47% of the vote, Clinton would grab 51% of the delegates. But that's only the beginning.

Delegates are also rewarded based upon the results from each voting district. Each district is distributed a certain amount of delegates (usually three) and they are split up depending on the votes from each district.

Do you see why this is the dumbest process ever?

With this nominating procedure you're left with situations such as Texas, where Hillary Clinton won the overall popular vote, but it looks as if she'll draw with Obama on delegates if not fall short.

So the people that voted for Clinton will be represented at the convention with more Obama delegates. Does that make any sense?

To make it even worse democratic elites thought they should get two votes. So they invented super delegates.

Super delegates are extra special people in the democratic party that are so awesome that they get to vote twice. Well, not literally.

They're Americans so they can vote in their state's primary or caucus, but remember they're also kick ass democrats, so they can endorse any candidate they choose and that candidate picks up another delegate.

Power to the people! Or should I say, power to the DNC elite!

This sucking away of popular sovereignty on behalf of the left has put them in a little bit of a bind.

As of right now neither Obama or Clinton are anywhere near enough delegates to secure the nomination. And if the states continue to split, there's likely not going to be a clear nominee come convention time. But wait! There's a solution. Those flippin' sweet voters called super delegates. They'll sweep in and decide the nominee.

The problem? This country isn't based off of Washington bureaucrats that the DNC feels compelled to knight superior to the average man. It's based off of the American people, and they should decide the nominee.

So how can we do it right? Is there a process out there that would easily pick a nominee with no doubt in anyone's mind. The answer is yes. And we happen to execute the process the first Tuesday of every November.

Our primary voting needs to run just like our general election, minus the electoral college. That means every single state in the union votes for their party's nominee on the same day. We get rid of the delegates and who ever wins the largest percent of American's is the winner. Game, set, match.

We can still have time to evaluate each candidate. We can hold more debates, that actually engage the audience and aren't censored by the media. The candidates can have more rallies and the citizens of this country can ask more questions. But there's no sense in spreading out the votes across six months when most people have their mind made up after two.

Not to mention that a candidate can gain "momentum" and win states that fall later on the calendar. I'm sorry but last I checked this wasn't a game of basketball, this was electing the leader of the free world. A candidate shouldn't have to pick up momentum as strategy, that person should be elected based on their merits and their beliefs, not because they won Iowa or Ohio.

If we do that we'll be able to cut the number of days the electing process takes in half. Because while it's been over 400 days since this darn thing started, there's still 292 days left.
